It is also extremely important to collect all relevant information for potential interested parties. This information includes, among others: documents regarding repairs or renovations, type/form of ownership of the property, amount of rent, area of ​​the property, method of heating, form of ownership of the plot, etc.

The description of the property does not match reality?

If the description of the property from the secondary market does not match the reality, the Seller is responsible for incurring all costs related to the repair of non-compliance regarding the physical or legal condition of the property.

Example

The advertisement stated the following information: the property has 100 m2. In fact, the area of ​​the property turned out to be 3 m2 smaller than in the advertisement. Then the Buyer has the right to demand a reduction in the price of the property and/or compensation

How to choose the right real estate agent?

As I mentioned earlier, from January 1, 2022, the Seller is fully responsible for information regarding the property put up for sale. According to Lov om avhending av fast eigedom (avhendingslova) a person selling a house or flat in Norway is obliged, among other things, to:

  • Providing all information relevant to the Buyer regarding the property.
  • The correct completion of egenerklæringsskjema.
  • Checking whether the information contained in the prospectus and the report on the technical condition of the property is correct and consistent with reality.

The process of selling real estate in Poland differs to a large extent from the process of selling real estate in Norway. Therefore, it is immediately important that the real estate advisor, in a manner understandable to the Seller, pays special attention to the differences regarding, among others: pre-emption rights (forkjøpsrett), form of ownership of the property, amount of rent, etc. Another important issue is to ensure that the documentation regarding the property is correct.
