Proposed changes to the law on infection control

The Norwegian Police Directorate has now sent its consultative reply. It is about proposed changes to the law on infection control to the Ministry of Justice and Preparedness in Emergency Situations. At the same time, the Ministry of Health and Welfare on consultations on proposed amendments to the infection control act until the curfew was introduced. In its response, the Police Directorate also included responses from police districts and special bodies.

The curfew is considered a bit alien and breaks the contract

Police Directorate is skeptical about the curfew as a tool. Mostly because the curfew is considered a bit alien and is a breach of the general agreement in Norway between the authorities and citizens. Breaking an agreement based on mutual trust. Moreover, it is stressed that it will not be a proportionate measure in the case of Covid-19. It is also pointed out that the challenges of law enforcement (a possible curfew) can lead to a weakening of confidence in the police.

A legislative process in parliament is desirable

In the event that a curfew is deemed an appropriate solution. The Norwegian Police Directorate agrees that a special provision legal framework will provide better legal legitimacy for the curfew than the current law on infection control § 7-12. In such a case, a legislative process in parliament is desirable. Which will enable changes in this matter to be taken into account in a practical and compliant way.
