Coronavirus certificate - proposed changes to the act on counteracting infections

The government submits a proposal to the Storting regarding temporary changes to the Infection Prevention Act along with the legal basis for the coronavirus certificate. The aim of the new regulations is to create a system of safe and verified documentation of vaccination status, immunity after COVID-19 and test results. In addition, the proposal will facilitate the implementation of the upcoming EU regulation and empower the Ministry of Health and Care to regulate the use of certificates coronavirus by regulation when necessary.

- Domestic use of the coronavirus certificate will be appropriate in the first instance for public events, cruises and other "package tours" as recommended by the Health Authority and the Norwegian Institute of Public Health. We are also wondering if it is appropriate to use the certificate in other areas and municipalities with stricter restrictions than national restrictions, said Minister of Health Bent Høie. The government has asked authorities to consider whether it is possible to use the coronavirus certificate earlier than Stage 3 when re-opening the public in several areas, and asked them to consider bringing it to local use.

Faster reopening

- The government believes that the coronavirus certification will be able to facilitate the gradual and controlled re-opening of society. This could contribute to a faster re-opening across the country, stressed Høie. The use of the coronavirus certificate will cease when infection and vaccination levels indicate that there is no longer any need for restrictions. So do EU rules
must be limited in time.

It is up to each country to decide whether to apply nationally.

- The first version of the Norwegian Coronavirus Certificate is now available on helsenorge.no. The certificate confirms the test result and whether you have been vaccinated against the coronavirus. Efforts are currently underway to further develop this certification into a coronavirus certification in line with the EU framework. The coronavirus certification must function both domestically and internationally, says Høie. Public consultations On May 5, 2021, the Ministry of Health and Welfare submitted for public consultations a proposal of a new, temporary chapter 4A of the Act on preventing infections. The ministry received a total of 10 consultations. They have all been read and the opinions are reflected in the ministry's assessments.

The coronavirus certification has generated a lot of commitment and there is disagreement among advisory bodies as to whether such certification should be introduced. While some view the certification as a useful and fair tool in the necessary reopening of society on the one hand, others view the coronavirus certification as a threat to Norwegian society.

Offices' position.

Public offices and larger organizations are mostly positive about the proposal. Some university lawyers believe that the proposal does not meet the requirements of a clear legal basis. About 10 private individuals made the statements
consultation. Most of these people are critical of the coronavirus certification system.
