Another milestone in the development of regulations regarding artificial intelligence has been adopted. As a result of long-term discussions and cooperation between various stakeholders, an agreement was reached on comprehensive regulations that aim to ensure the trustworthy implementation and use of artificial intelligence.
MEPs reached a political agreement with the Council on a draft law ensuring the safety of artificial intelligence in Europe, respect for fundamental rights and democracy, and the ability for businesses to prosper and develop.
law on artificial intelligence was created in response to the dynamic development of this field and understanding the need to regulate aspects related to ethics, privacy, security and transparency in the applications of artificial intelligence.
Key elements of the established rules include:
Ethical AI principles: Defining fundamental principles of conduct for the design, creation and use of artificial intelligence, with an emphasis on respect for human rights, justice and fairness.
Accountability and transparency: Establishing rules of responsibility for actions taken by systems based on artificial intelligence, as well as requiring transparency in the decision-making process of algorithms.
Security and privacy: Providing appropriate security measures and data privacy protection personal data in artificial intelligence applications.
Monitoring and regulation: Establish mechanisms to monitor and regularly assess regulatory compliance to ensure continuous adaptation to the changing technological environment.
International cooperation: Striving for international cooperation in the field of artificial regulation intelligence to ensure global consistency of action.
The regulation aims to providing protection fundamental rights, democracy, the rule of law and environmental sustainability against high-risk AI, while driving innovation and making Europe a leader in this field. The regulations establish obligations regarding artificial intelligence based on potential risk and level of impact.

What is forbidden
Recognizing the potential threat to citizens' rights and democracy posed by some applications of artificial intelligence, the co-legislators agreed to prohibit:
- biometric categorization systems using sensitive features (e.g. political, religious, philosophical beliefs, sexual orientation, race);
- untargeted downloading of facial images from the Internet or CCTV footage to create facial recognition databases;
- recognizing emotions in workplace and educational institutions;
- social scoring based on social behavior or personal characteristics;
- artificial intelligence systems that manipulate human behavior to circumvent their free will;
- Artificial intelligence is used to exploit people's weaknesses (due to their age, disability, social or economic situation).
Enforcement exceptions rights
Negotiators agreed to a number of safeguards and narrow exceptions. They concern the use of biometric identification (RBI) systems in publicly accessible spaces for law enforcement purposes, subject to prior court authorization and in the case of well-defined lists of offenses. The “remote” RBI would only be used for targeted searches a person convicted or suspected of committing a serious crime.
A real-time RBI would meet strict conditions and its use would be limited in time and place, for the purposes of:
- targeted search for victims (abductions, human trafficking, sexual exploitation),
- preventing a specific and present terrorist threat, or
- location or identification of a person suspected of committing one of the specific crimes listed in the regulation (e.g. terrorism, human trafficking, sexual exploitation, murder, kidnapping, rape, armed robbery, participation in a criminal organization, environmental crime).
This agreement is a step forward in shaping the environment. It will enable the development of artificial intelligence while respecting ethical values and responsible principles use of this technology.
The bill is expected to be submitted for further legislative procedures in the near future, opening discussion on topic of a new legal framework for artificial intelligence.
