In April 2022, the Law on the Defense of the Homeland entered into force in Poland, which introduced new rules regarding conscription to the army and the obligation to appear for exercises. In 2023, certain regulations apply to Polish citizens, in particular regarding persons staying abroad.
Military qualification in 2023 - who does it cover?
According to regulations regarding military qualifications, the obligation to appear for this procedure applies to all men and some women who turn 19 in a given calendar year. Women covered by the obligation are graduates of public and private universities who study in specific fields, such as medical analytics, pharmacy, medicine, dentistry, nursing, psychology, emergency medical Services, veterinary medicine, and in post-secondary schools training in the professions of pharmaceutical technician and veterinary technician.
Conscription to the army and stay abroad 2023 - Who is subject to the obligation?
Persons subject to the obligation to appear at military exercises they are reserve soldiers. This includes, among others: persons transferred to the reserve after being released from active military service and persons who did not complete their service but in still are subject to compulsory military service in accordance with specific regulations. Reserve soldiers are obliged to participate in military exercises, and failure to report at a specified time and place may result in arrest or a fine.
Conscription to the army and stay abroad - What is the situation of people staying abroad?
Drafting into the army does not include reserve soldiers, who have permanent residence abroad and are able to prove this fact. In the case of citizens Polish staying abroad, the mere fact of staying abroad does not automatically exempt them from the obligation to appear for military exercises or military qualifications. These persons must report their residence or stay abroad to the competent offices or provide appropriate documents confirming their permanent residence abroad. Lack of registration in Poland or having a certificate confirming permanent residence in another country may constitute evidence for permanent residence abroad. In the case of reserve soldiers who went abroad but did not report this fact, if they receive a call for military exercises, they should appeal against the administrative decision, presenting documents confirming their residence or work abroad.
Obligation of active military service and going abroad
Persons subject to the obligation of active military service are obliged to report to the head of the WCR (Military District Commander) any changes regarding their personal data and information about traveling abroad for a period longer than six months. In the event of a change of permanent or temporary place of residence lasting more than three months, as well as departure or return from abroad, this information must be reported to the relevant WCR.
