– When foreign transport companies send drivers on assignments in Norway, they must have Norwegian pay and working conditions. This means, among other things, that there will be universal wage requirements, says Employment and Integration Minister Marte Mjøs Persen.

The proposed new regulations clarify when drivers employed in foreign transport companies and carrying out road transport to and/or within Norway should be considered posted workers.

The driver must have documentation

Moreover, the ministry proposes that foreign transport companies before entering Norway had to register certain information about the company, driver, vehicle and tasks with the Norwegian Labor Inspectorate.

“Such a registration scheme will provide a better overview of the activities of foreign hauliers in Norway, and therefore a better basis for supervision and control,” says Mjøs Persen.

According to the proposals, foreign transport companies must also ensure that certain documents are available in the vehicle and can be presented at roadside checks, and respond to specific inquiries from the Norwegian Labor Inspectorate regarding wages and other relevant issues after posting. Registration of information and subsequent contact will take place via the EU's Internal Market Information System (IMI).

Applications are submitted for public consultation

The proposed regulatory changes implement the provisions of the EU Directive 2020/1057 on the posting of drivers into Norwegian law. Applications are submitted for public consultation with an eight-week consultation period.
