Company bankruptcy in Norway

It is not difficult to bankrupt the company. A few unprofitable orders or incorrectly signed contracts are enough and even a prospering company may find itself on the verge of bankruptcy. It is worth knowing what your rights are as an employee in Norway, if your employer is threatened with bankruptcy.

Company bankruptcy - first symptoms

First of all, the moment when we realize that the company is no longer profitable is crucial. The best solution for an employee is before the bankruptcy of the company is declared. How can you recognize a deteriorating situation? First of all, after the employer ceases to pay his liabilities on a regular basis.

However, it does not necessarily have to affect the employees themselves in the first place. Most often, companies in first of all, they stop paying their own people regularly suppliers and other contractors. If we observe such a lack of liquidity, it is worth considering changing the place of employment. We should certainly consider such a solution when the employer starts paying employees' salaries later and later.

When the bankruptcy of the company has already been announced

The situation gets a bit more complicatedwhen the employer has already announced the bankruptcy of the company. Then the employee has the right to assert his rights and his claims can be satisfied Government Fund Wage Guarantee (Norwegian) Statens lønnsgarantiordning). This is possible provided that the employer's arrears to the employee do not go back more than 12 months from the date the court received the application to initiate bankruptcy proceedings. In case of remuneration leave period is 24 months.

How do I get my salary back?

In order to recover your debts, the first step is to register your claim with the trustee conducting bankruptcy proceedings. To do this, you must complete an application that can be found online or obtained directly from the trustee. An additional requirement is to register with NAV as job seeker within 14 days of receiving written notice from the trustee about the termination of the employment contract.

Important dates

It is worth remembering several applicable and deadlines. First of all, Government Wage Fund Guaranteed companies can cover the outstanding remuneration only for 6 months of work. Not only the basic part of the remuneration is included, but also other due fees. Application for satisfaction of a claim must be reported to NAV lønnsgaranti, which will consider the application within approximately 2 months.

How much will you receive?

After positively considering the application, the office will instruct the trustee to order the payment. The funds will be transferred to your account immediately. However, it will reduce your remuneration by any deductions, such as taxes. If we have doubts about the funds awarded to us, we have the right to appeal against the decision. Obligatory the deadline is 3 weeks, and we must submit the appropriate letter to NAV lønnsgaranti.
