NAV-People on sick leave may have been refused payment for the wrong reasons

If you suspect that you may have been injured, NAV asks you to contact us. The case applies to you if:

  • you had several jobs at the same time,
  • you haven't been to sick leave in all workplaces,
  • you received a refusal decision because your income fell by less than 20%,
  • you received a refusal decision before January 1, 2022.

Employers can also be penalized in the case of returns.

“It is not possible for NAV to identify exactly which cases may have been rejected for the wrong reasons. That's why it's important that people who believe they've been harmed contact us so that we can reconsider their case," said Director of Benefits Eve V. Bergli.

If you suspect that your application has been rejected for the wrong reasons, you can contact NAV in writing at nav.no/kontakt. You can also call the telephone number 55 55 33 33. If the employer believes that he has been injured, the employee must contact NAV.

“We have reason to believe that this is a small number of cases, and most likely will be small amounts over short periods of time in cases that are significant. However, it is important for us to review the reported cases again and ensure that applications receive the appropriate outcome,” added Bergli.

In the judgment of November 2, 2021, the Supreme Court ruled that it is not required that the decrease in income be at least 20%. It is sufficient that the working time has been reduced by at least 20%. This means that the NAV cannot reject the application just because the decrease in income is less than 20%. NAV changed the practice after the judgment.
