As it turns out, every year there are more and more problems related to the implementation of individual industry projects or within companies operating in the construction industry. The Labor Inspectorate in Norway decided to address this issue. Infringement fees are rising. What do we know more? Can we avoid the fee?
Let's look at the numbers…
The statistics are devastating. The number of violations in the industry is increasing. We can observe a gigantic increase since 2015/2016. Many cases end up in court. Specialists warn that the number of cases has even doubled. Typically fees apply medium and large companies – multi-month projects that cannot be completed for various reasons.
Who may be subject to a penalty?
The fee may be imposed on any specialist who actively participates in the implementation process - from the contractor, through the construction company, the investor. Most of the cases concern inconsistencies between implementation plans, design and execution. Many companies still neglect current building regulations. Safety rules on the construction site are violated. Nowadays, time is very often important - companies want to hand over the building "turnkey" quickly. As a result, compliance with building regulations gives much to be desired. Courts and experts emphasize building rules constitute central building regulations. Their violation generates problems and is the reason for the payment order.
What amounts are we talking about?
Let's summarize: Three cases were brought to the District Court, involving fees of NOK 600, NOK 000 and NOK 300. The Labor Inspectorate keeps a watchful eye on the industry construction for a good two or three years. Many factors influence this. Some important projects are being extended. We wrote about it in one of our recent publications: Conflicts in Norwegian construction - financial losses! Probably the number of inspections will increase. For this reason, Norwegian construction companies must be careful.
