Nav refused sickness benefits to sick people who should have received it

A new Supreme Court ruling could cause Nav to change its practice of paying sickness benefits to people on sick leave with several working conditions.

The woman from Smøl fought Nav all the way to the country's highest court, Dagens Næringsliv reports. She was partially on sick leave in one of her two jobs in 2017 and expected to receive sickness allowancebecause she was unable to work.

According to the wording of the act, in order to be entitled to sickness benefit, she had to be 20% incapable of work. But Nav he believed that since a woman had not lost more than 18 percent of her income, she was not entitled to sickness benefit.

Discrepancy between remuneration and percentage of work was due to the fact that the woman had the lowest salary in the job she was able to perform. Nav referred to its own circulars, which in turn were based on the agency's interpretation social security act.

Supreme Court believes that this circular was not specific enough in law. Nav is currently taking note verdict.

- We registered the verdict with the Supreme Court and we need some time. We need to take a closer look at what this means for Nav practice before we can comment on it, writes the director of the performance department, Liv Tove Espedal, in an email. to DN.
