Whether you're renting a small room in your home or your entire home, there are a number of laws and rules you must follow as a landlord. This includes everything from ceiling height requirements to fire safety.

There are some general rules you must follow when renting a home. These rules should provide for both you as the landlord and your tenant. Most of the rules are anchored in the Rent Act. They talk about the terms of the lease, the deposit and the adjustment of the rent.

If you find yourself in a situation where a tenant is not paying rent, you must also comply with the Enforcement Act. By When renting a house, it is a good idea to familiarize yourself with these rules.

In addition, the house must be approved as rental accommodation. If not, at worst, you risk a fine. It is the municipality that approves the houses for rent.

In order for a house to be approved for rental, it must meet certain requirements set by the authorities. They are national in nature and concern health, environment and safety. Among other things, they are placed requirements for:

  • Ceiling height
  • Escape routes
  • Windows
  • Ventilation
  • Fire separation
  • Radon measurement
  • Bath
  • Cabinet space

These requirements are described in Tek17. For older homes, the requirements are slightly different. For example, there are no such strict requirements for ceiling height and accessibility.

All in all, this needs to be sorted out before renting your own home, whether it's a room, flat or house:

  • The unit must meet the requirements of the authorities
  • For this purpose, the unit must be approved by the municipality

Rules for renting an apartment in your own home

Are you renting an apartment that is part of your own home? Then you must first check whether it meets the requirements to be legally rented. Must also have a permit for permanent residence. You must apply to the municipality for this.

At When renting, a distinction is often made between an apartment and an apartment as a standalone unit or as part of an existing home. What makes them different is whether there is a separate entrance or not. If the house is a stand-alone unit, slightly more stringent ones apply requirements. These include fire safety and bathroom facilities.

The apartment for rent must be at least 2 meters high. If the roof is sloping, the ceiling height may be lower, but this may only be half the room. Rules for renting rooms in your own home

You can rent a room in your own home, even if it is not approved as a residence hall or your own rental apartment. However, the room must have a permanent residence permit.

If you rent a room in your own home or as a housing Association, it is not an independent residential unit. This means there is none possession requirement private bathroom, but the tenant must have access to the bathroom and toilet in the house where the room is located.

Dormitory rental rules

A residence hall is a smaller part of a house or apartment and is therefore not a separate living unit. The tenant must have access to a bathroom and toilet, but does not need to have their own.

In addition, the rooms included in the dormitory must be admitted to permanent residence by the commune and meet the requirements for, inter alia, escape routes, ceiling heights and windows.

Are you going to rent a basement apartment? As with other types of rental housing, you must apply for approval. Ceiling height may be a challenge in basement apartments. The authorities require a minimum ceiling height of 2 meters, even if some parts of the house have a lower ceiling height, for example with sloping roofs.

House renting

Requirements are also placed on escape routes and windows. If your home is below ground level, this can be a challenge. If you rent a home without sufficient escape routes and windows, you will be liable in the event of a fire. Violation of these rules may result in a fine being imposed, but it is also the basis for the tenant to sue you as the owner.

As a landlord, you can run into unforeseen obstacles to your tenants.
