Polish construction law - important changes!

New modifications to building regulations will come into force soon. They will certainly please not only developers and representatives of the broadly understood real estate industry, but also individual clients themselves. In comparison, until recently some provisions sounded unfavorable for people making any investments. What will change? Here's a short cheat sheet!

Polish construction law more investor-friendly ...

We are talking here about the amendment of February 13, 2020 (Journal of Laws of 2020, item 471). It contains favorable provisions for all investors. It is worth noting that the term "investor" covers both a large entrepreneur operating in the construction / real estate industry and a private person buying or renovating his single-family house. What will change?

  • simplified procedures for legalization of investments will come into force - the authorities will not check the compliance of investments with planning acts. Verification of the construction will be carried out in the scope of ascertaining the safe use of the building, without threat to life. There will be no legalization fee,
  • annulment of the decision o building permit will only be possible for up to 5 years. Previously there was no time limit,
  • it will be possible to use the building without a permit for up to 60 days - only after this date, the authority will be able to impose a fine. Building inspections only once every 30 days,
  • a larger catalog of objects without a building permit. Among them there are: detached single-family buildings standing on the plot that was included in a given project, water supply, sewage, heating, gas networks (with an operating pressure not higher than 0,5 MPa), power networks (with a rated voltage not higher than than 1 kV), sewage treatment plants with a capacity of up to 7,50 cubic meters. XNUMX hours, septic tanks, temporary construction facilities not connected to the facility to be demolished,
  • shorter deadlines for issuing conditions for connections to the water supply and power network. 21 days for single-family houses. 45 days at other facilities,
  • the architectural and construction administration authority will be able to consent to a derogation before issuing a decision on a building permit or decision to change building permits.

 To sum up. What else will change?

To sum up. Polish construction law. What else will change. It will be much easier to put devices such as an ATM, a parcel machine. No special permits will be needed. This also applies to the creation of a terrace up to 35 sq m. It is worth noting that there is a certain risk here, because the legislator did not specify what permits will be necessary in the further stage of such implementation.
