Spring is here, the time of planning vacations and summer trips is approaching.
Everyone is entitled to an annual holiday of at least 25 working days. If you are over 60, you are entitled to an additional week of holiday leave.
Working days are working days of the week including Saturdays. Sundays and public holidays do not count as working days. As a rule, there are 6 working days per week. Therefore, the employee is entitled to four weeks and one day of vacation each calendar year.
These are six questions that the Norwegian Labor Inspectorate often receives
Who really has the last word when your vacation time is due? What about vacation when you've just changed jobs? These are six questions that the Norwegian Labor Inspectorate often receives.
Who decides when should I have a vacation?
The employer largely decides on the date of leave. As an employee, however, you can request a minimum of three holiday weeks up to the main holiday period (June 1 - September 30). You can also request the end of the remaining leave in connection with this.
When can I state that I know the time of my vacation?
The employer should discuss the leave schedule and schedule with the employee or shop steward in advance.
If there are no special reasons that prevent this, you should get to knowthe date of the leave not later than two months before the start of the leave.
What happens if I don't agree on a leave date with my employer?
If you do not agree with the employer on the date of the main vacation period, the employer has the final say. However, you can request to add three holiday weeks to the main holiday period, which is June 1st to September 30th.
Do I need to take a vacation?
The employer has a duty to make sure that the holiday is taken and you are obliged to take the holiday.
All statutory holidays not taken during the holiday year shall be transferred to the following holiday year. This also applies to cases where an employee, for example, has been sick for several years and has a lot of unused vacation.
In the event of illness during the holiday period, you can request that unused holiday days be moved within the same calendar year. Such a request, documented by a sick leave, should be presented as soon as possible after returning to work.
Leave must be taken. You may not receive a holiday allowance for a holiday that has not been completed or carried over to the next holiday year. This also applies to cases where there is talk of transfer due to incapacity for work or parental leave.
The only possibility of receiving holiday allowance for holidays that have not been completed is when the employment relationship ends.
I started a new job. Am I entitled to holiday leave?
You have both the right and the obligation to take time off, even when you start a new job.
In order to be able to apply for leave from your new employer, a prerequisite is that you have not taken the full leave from your previous employer.
In order for your employer to claim your holiday, you must have earned holiday allowance in the previous year from your current or previous employer.
You have the right to do so:
- full leave (25 working days) until the end of the same holiday year if you join no later than September 30 in the holiday year
- three weeks' holiday in the main holiday period (June 1 - September 30) if you start working by August 15 of the holiday year
- at least one week's holiday in the same year if you join after September 30th
