In most cases, transferring some vacation days to the next year is hassle-free.
Because although the general rule is that all leave must be taken within a calendar year, you can make arrangements with employer transfer of up to 12 days of leave for the next year.
The employer must consent
– Employees are still not entitled to transfer vacation days. Since the employer is obliged to ensure that the employee takes the leave, an agreement should be concluded to transfer up to 12 days to next year, says section manager Vigleik M. Aas of the response department Norwegian Labor Inspectorate.
– Both parties must agree and the contract must be in writing.
Find good solutions
Norwegian Labor Inspectorate states that there is little disagreement on this issue in Norwegian workplaces.
– We don't often hear about conflicts over the transfer of vacation days. Both employer and employee they want above all, find good solutions, says Aas.
– Remember, however, that transferring leave is an exceptional decision. It is best to plan to use all your vacation days during the year to maintain a balance between work and rest.
Time to take a vacation?
According to holiday law As a rule, more than 12 days of leave cannot be transferred to the next year. In other words, you can't save an unlimited number of days, and your employer also can't ask you to transfer more than 12 days.
If you have a few vacation days left in your vacation account, now is the time to use them.
– Try to find a vacation spot beforehand Christmas. Contact your employer and plan this as soon as possible, says Vigleik M. Aas.
Collective labor agreements may contain more extensive provisions
Many employees have collective agreements that contain different leave transfer provisions than Holiday Act. So even if the law says one thing, your employment contract may say another.
However, negotiated collective agreements cannot be less favorable to you as an employee than the legislation.
– Many of them also have internal defining rules deadlines for submitting applications for leave. Of course, they need to be dealt with, even if they are not regulated, says Aas.
What about sickness or parental leave?
If you were unable to take your holiday days during the holiday year due to illness or parental leave, the law states that all unused holiday days they have to stay transferred to the next year.
